Justice, cardinal stone of any society, is expected to see his role increase significantly in our country.
Systemic changes experienced cause more profound changes that undoubtedly an impact on the legislative corpus and regulating the balance between rights and duties of individuals and institutions.
This shift challenges the Algerian justice for constant adjustments , hence the importance of the training of judges.
Moreover, this concern is stated by the provisions of Section III concerning training of Chapter I covering training, recruitment, appointment and tenure of Title III relating to the organization of the career of Organic Law n ° 04-11 of 6 September 2004 on the status of the judiciary ( OJ No. 57 of 8/ 09/ 2004), which have the obligation of every magistrate activity to be subject to this training.
Indeed, the provisions of the following sections specify this obligation:
" Art. 42 . - Continuing education tends to professional and scientific training of judges in activity.
Art . 43 . - Are subject to continuing all magistrates in training activity .
Art . 44 . - For the evaluation , grading and promotion of the magistrate, it is considered the efforts made during the training cycles .
Art . 45 . - The Minister of Justice may grant the magistrate , with the approval of the Superior Council of the Judiciary, a paid study leave for a period of one (1) year, may be extended for a period not exceeding one year, to conduct research on any topic related to judicial activity .
The arrangements for implementing this Article shall be determined by regulation . "
Also, in accordance with Article 5 of Executive Decree No. 05-303 of 20 August 2005 on the organization of the Graduate School of the judiciary and laying down procedures for its operation, access conditions , diet studies and the rights and obligations of student judges (OJ No 58 of 25/08/2005 ) the school 's mission is to provide basic training for trainee judges , continuous training, retraining and advanced training of magistrates year.
The training given by the ESM directly responds to the needs expressed by the judges. Closer to the concerns of the magistrate , richer, more diverse and more technical, it allows judges to open the usual partners of the institution by co- organizing and co- participation with certain partners including governments.
Indeed , the magistrate is not only a lawyer , he has delicate features that confer considerable powers in a complex social context and evolving . He must understand the implications of his statement to better adapt . This is why the continuing education program includes activities of reflection, awareness and openness.
